Stopped at the Border: Why Regulatory Compliance Is Crucial for Cosmetics and How to Avoid Risk

In today’s global marketplace, the cosmetics industry is booming with opportunity, but for brands looking to sell in the UK and EU, there’s one critical factor that can mean the difference between success and a shipment seized at customs: regulatory compliance.

We recently saw a post by a UK customs officer on LinkedIn which served as a stark reminder of this reality. The officer shared how cosmetics are regularly stopped at the border because they lack the proper documentation and fail to meet legal standards. It’s a growing issue – and one that underscores just how many brands remain unaware of the stringent requirements involved.

At Guardpack, we have seen this time and again: businesses mistakenly believe that launching a cosmetic product is as simple as having a formula and packaging it up. But the legal requirements for cosmetics in the UK and EU are complex and non-negotiable. Misunderstanding them can lead to costly delays, reputational damage, and even legal penalties.

As a trusted UK manufacturer, we break down the myths, the facts, and how you can avoid your product being ‘stopped at the border’.

“All I need is a Safety Data Sheet

This is one of the most common misconceptions we hear. Many brands think that a Safety Data Sheet (SDS) is all that’s required for a cosmetic product to be sold legally. The truth is that cosmetic products are actually exempt from needing SDSs under UK and EU law. What you do need goes far beyond that, and without it, your product isn’t legally marketable.

What’s Legally Required to Sell Cosmetics in the UK and EU?

Here’s what every cosmetic product must have before it can legally be sold or exported in the UK and EU:

  1. Cosmetic Product Safety Report (CPSR)

This is a detailed toxicological and safety assessment conducted by a qualified safety assessor. It ensures that the product is safe for human use when applied under normal or reasonably foreseeable conditions.

  1. Product Information File (PIF)

The PIF is a comprehensive dossier containing everything from the CPSR to manufacturing methods, proof of claimed effects, and animal testing declarations. This must be readily accessible to authorities at a UK or EU address.

  1. Proper Labelling

Cosmetics must comply with strict labelling rules, including:

  • Ingredients (INCI names)
  • Use-by dates or PAO (Period After Opening) symbols
  • Manufacturer or Responsible Person contact details
  • Batch numbers for traceability
  • Product function, unless it’s clear from the presentation
  1. Responsible Person (RP)

Under both UK and EU law, a designated Responsible Person must be appointed to ensure regulatory compliance. This individual or company must be based within the region of sale (UK or EU) and is legally accountable for the product’s conformity.

  1. Product Registration

Before any cosmetic product hits the market, it must be registered:

So, Why Are Products Still Being Stopped at Customs?

Many brands either aren’t aware of these requirements or rely on suppliers who don’t provide proper documentation. When customs officials request a PIF or evidence of RP registration and it isn’t available, the product is seized or destroyed. No appeal, no refund, just loss.
