Cosmetic Regulations: Should UK Brands Follow EU Cosmetic Legislation Changes?

As cosmetic regulations consistently evolve, one key question arises for UK brands: should they align with all EU legislation changes, even after Brexit? The EU’s Expanded List of Fragrance Allergens

In July 2023, the European Union (EU) expanded its list of declarable fragrance allergens in cosmetic products from 24 to 80 substances. This significant update to cosmetic labelling requirements does not alter the actual formulations of existing products but mandates that manufacturers disclose a broader range of potential allergens. This increased transparency is intended to help consumers make informed choices and avoid substances that might cause allergic reactions.

Previously, only 24 allergens needed to be listed on product labels. Now, with an additional 56 substances added, European consumers will start noticing a longer list of ingredients on their favourite perfumes, creams, and other cosmetic products. While this might seem overwhelming, it is ultimately a step forward in consumer safety and awareness.

New products placed on the market from July 31st 2026 need to comply with the new list, with the deadline for removal of existing cosmetic products July 31, 2028.

Should UK Brands Follow These Changes?

Prior to Brexit, the UK has always had to follow EU cosmetic regulations. However, now that the UK is no longer part of the European Union, it remains unclear whether the UK will officially adopt this specific amendment into its own cosmetic regulations. Alignment is anticipated but at present, companies operating in both the UK and EU markets must navigate potential regulatory differences.
